I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to all contracts concluded with us, the provider (Hans Wilhelm Hirse), via the website www.vitalmatte.store. Unless otherwise agreed, the inclusion of your own terms and conditions is expressly rejected.
(2) A consumer within the meaning of the following regulations is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is any natural or legal person or partnership with legal capacity who acts in the exercise of their independent professional or commercial activity when concluding a legal transaction.
§ 2 Conclusion of Contract
(1) The subject matter of the contract is the sale of goods.
(2) By displaying a product on our website, we make a binding offer to conclude a contract under the conditions specified in the item description.
(3) The contract is concluded via the online shopping cart system as follows: The goods intended for purchase are placed in the “shopping cart.” You can view and modify the shopping cart at any time. After clicking the “Checkout” or “Proceed to Order” button and entering personal, payment, and shipping details, you will see an order summary. You may then confirm or change the information, or cancel the process. By clicking the purchase button (“order with obligation to pay”, “buy now”, “checkout”, etc.), you accept our binding offer and the contract is concluded.
(4) Inquiries about offers made outside the shopping cart system are non-binding. We will provide a binding offer in text form (e.g., by email) which you may accept within 5 days.
(5) Orders and communication are handled by email. You must ensure that the email address you provide is correct and that you can receive our emails.
§ 3 Special Provisions for Payment Methods
For payment methods offered via third-party providers (e.g., easyCredit, Klarna, Ratepay, Novalnet, PayPal, Mollie, Stripe, Secupay, Unzer), the respective providers’ terms and conditions apply in addition to ours. Details and links are provided in the German version of these Terms and Conditions.
§ 4 Right of Retention, Retention of Title
(1) You may only exercise a right of retention if it arises from the same contractual relationship.
(2) Goods remain our property until full payment has been made.
§ 5 Warranty
(1) Statutory warranty rights apply.
(2) Consumers are requested to check goods immediately upon delivery for completeness, obvious defects, or transport damage, and to notify us and the carrier promptly. Failure to do so does not affect your statutory rights.
(3) Deviations in product characteristics from objective requirements are deemed agreed only if expressly confirmed separately before contract conclusion.
§ 6 Choice of Law
(1) German law shall apply. For consumers, this choice applies only insofar as protection granted by mandatory provisions of the law of the consumer’s country of habitual residence is not withdrawn.
(2) The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

3. Contract Language and Storage
(1) The contract language is German.
(2) We do not store the full contract text. Before placing the order, you may print or electronically save your order details using your browser. After the order is placed, you will receive all legal information and the Terms & Conditions by email.
(3) For individual offers outside the shopping cart system, you will receive all contractual information in text form (e.g., by email).
4. Essential Characteristics of Goods or Services
The essential characteristics of goods and/or services are contained in the respective product description.
5. Prices and Payment
(1) All prices include statutory taxes and charges.
(2) Shipping is free of charge.
(3) For deliveries outside the EU, additional costs such as duties, taxes, or transfer fees may apply and are borne by the customer.
(4) Transfer or exchange fees for payments initiated outside the EU must be covered by the customer.
(5) Available payment methods are displayed on our website and during checkout.
(6) Unless otherwise specified, payment is due immediately upon contract conclusion.
6. Delivery Conditions
(1) Delivery times and conditions are displayed on our website and during checkout.
(2) Risk of accidental loss or damage passes to consumers only upon delivery, regardless of shipping method, unless a carrier chosen by the consumer (not designated by us) is used.
7. Warranty Rights
Warranty rights are governed by Section § 5 of our Terms and Conditions above.
